General Terms and Conditions of Booking and Services
These general terms and conditions govern the relationship between RelaXcenter, a spa, wellness, beauty, and hair center in Djerba, and any person submitting a booking request or booking a service through the website relaxcenterdjerba.tn.
The general framework for electronic exchanges and e-commerce in Tunisia is notably governed by Law No. 2000-83 of August 9, 2000, relating to electronic exchanges and electronic commerce.
1. Purpose
The purpose of these terms and conditions is to define the procedures for booking requests, confirmation, performance, modification, and, where applicable, cancellation of the services offered by RelaXcenter.
They apply to requests made through the website, by phone, by email, by message, or directly with the establishment.
2. Services offered
The services offered by RelaXcenter are those presented on the website, including massages, facial treatments, body treatments, hammam, sauna, jacuzzi, pool circuit, wellness programs, hair services, manicure, pedicure, hair removal, makeup, and other beauty or wellness services.
The descriptions, photographs, visuals, durations, and information displayed on the website are provided for informational purposes. They may be adapted according to availability, the center’s organization, the client’s condition, possible contraindications, or the conditions under which the service is performed.
RelaXcenter reserves the right to modify, adapt, suspend, or replace a service when necessary for organizational, safety, hygiene, or availability reasons.
3. Booking request
Any request made through the website, particularly through the booking form, constitutes a booking request and not a final confirmation.
The booking is considered confirmed only after express validation by RelaXcenter, by phone, email, message, WhatsApp, or any other confirmation method used by the establishment.
Submitting a booking form does not automatically guarantee the availability of the requested time slot, service, wellness program, or practitioner.
RelaXcenter undertakes to process received requests as soon as possible, according to opening hours and team availability.
4. Information provided by the client
The client agrees to provide accurate, complete, and up-to-date information when submitting a booking request.
This information may include the first name, last name, phone number, email address, desired service, desired date, desired time, number of people, and any useful information for the proper organization of the service.
In case of inaccurate, incomplete, or incorrect information, RelaXcenter cannot be held responsible for inability to contact the client, delayed confirmation, or poor organization of the service.
5. Prices
Service prices may be communicated on the website, upon request, during contact, at the time of booking confirmation, or directly on site at the establishment.
Unless otherwise stated, prices are expressed in Tunisian dinars, TND.
Prices may vary depending on the selected service, duration, chosen options, wellness program, number of people, or specific booking conditions.
When the website displays a price, it is provided for informational purposes, unless expressly confirmed by RelaXcenter.
6. Payment
Payment for services is made according to the methods communicated to the client by RelaXcenter, including on site or through the payment methods accepted by the establishment.
No online payment is required on the website at the stage of a simple booking request, unless expressly stated otherwise.
A booking request submitted through the website therefore does not constitute an online paid sale, but a request for contact and confirmation.
7. Booking confirmation
After receiving the request, RelaXcenter may contact the client to confirm availability, specify service details, validate the requested time slot, or suggest an alternative.
The booking becomes effective only after confirmation by RelaXcenter.
Without confirmation from the establishment, the request must not be considered a final booking.
8. Modification and cancellation
Any request for modification or cancellation must be communicated to RelaXcenter as soon as possible.
The client may contact the establishment by phone, email, or message using the contact details provided on the website.
In case of modification, RelaXcenter will do its best to offer a new time slot according to the center’s availability.
In case of late cancellation, significant delay, or unreported absence, RelaXcenter reserves the right to limit, postpone, or refuse certain future bookings.
9. Late arrival and absence
The client is invited to arrive at the time agreed upon during booking confirmation.
In case of late arrival, RelaXcenter reserves the right to reduce the duration of the service in order to respect the center’s schedule, without this necessarily giving the right to a price reduction or refund.
In case of unreported absence, the service may be considered cancelled. The establishment also reserves the right to refuse or limit certain future bookings.
10. Conditions for performing services
Certain services require specific precautions. The client must inform RelaXcenter in advance of any useful information that may influence the performance of the treatment or service.
This information may include:
allergy
pregnancy
particular sensitivity
known contraindication
medical issue
dermatological issue
ongoing treatment
recent intervention
unusual pain
circulation disorder
previous reaction to a treatment or cosmetic product
RelaXcenter reserves the right to refuse, postpone, adapt, or interrupt a service if safety, hygiene, organizational, or health conditions require it.
The services offered by RelaXcenter are wellness, aesthetic, beauty, or relaxation services. They do not replace medical advice, diagnosis, treatment, or care provided by a healthcare professional.
11. Hygiene, behavior, and safety
The client agrees to respect the rules of hygiene, safety, and proper conduct within the establishment.
RelaXcenter reserves the right to refuse or interrupt a service in case of inappropriate, disrespectful, dangerous behavior, or behavior contrary to the proper functioning of the center.
The establishment may also refuse access to a service if the client’s condition does not allow the service to be performed under proper conditions of safety, hygiene, or comfort.
12. Availability of services
Services, schedules, practitioners, equipment, and spaces may be subject to availability.
Certain services require specific organization, including wellness programs, specific massages, duo treatments, long services, hammam, sauna, jacuzzi, or pool circuits.
RelaXcenter reserves the right to suggest another time slot, another duration, an equivalent service, or an adapted program according to availability.
13. Liability
RelaXcenter cannot be held responsible for consequences related to inaccurate, incomplete, or omitted information provided by the client.
The establishment cannot notably be held responsible for:
errors resulting from inaccurate information provided by the client
consequences of omitted useful medical, dermatological, or personal information
client delay or absence
force majeure
external impediment beyond its control
temporary unavailability of a service, equipment, or practitioner
indirect damage
The client remains responsible for the information they provide and for their ability to receive the requested service.
14. Personal data
Data collected in the context of booking requests, contact requests, or exchanges made through the website are processed in accordance with the website’s Privacy Policy.
These data are used to process requests, organize bookings, contact the client, and ensure service follow-up.
The client is invited to consult the Privacy Policy to learn about the methods of collection, use, storage, and exercise of their rights relating to personal data.
15. Communication with the client
By submitting a request through the website, the client agrees to be contacted by RelaXcenter by phone, email, message, or WhatsApp in order to process the request, confirm a booking, or request additional information.
These exchanges aim to ensure the proper organization of the requested service.
16. Applicable law
These terms and conditions are governed by Tunisian law.
In case of difficulty, the parties will seek an amicable solution before any legal proceedings.
Failing an amicable agreement, the territorially competent Tunisian courts shall have sole jurisdiction, unless otherwise required by mandatory legal provisions.
